Acceptance of Terms

By creating an account, accessing, or using Mark My Listing, you agree to these Terms of Service. If you do not agree, you should not use the platform.

Permitted Use

You agree to use Mark My Listing only for lawful business or professional purposes and not for fraudulent, abusive, infringing, misleading, or otherwise unlawful activity.

You are responsible for the materials you upload or generate and for ensuring that your use of the platform complies with applicable laws, contracts, licensing rules, and advertising standards.

Your Content

You retain ownership of the content you upload to Mark My Listing, including images, logos, headshots, listing details, and brand materials.

By using the platform, you grant Mark My Listing the limited rights necessary to host, process, and transform that content in order to provide design generation and related product functionality.

Service Scope

Mark My Listing provides software tools for generating real estate design and marketing assets. The service is provided on an as-available basis, and we do not guarantee that the platform will always be uninterrupted, error-free, or available in every circumstance.

Free Editor and Optional AI

Manual editing, saving designs and downloads are free with a confirmed account and completed agent profile. No payment card or trial is required. AI assistance is optional and paid. Custom website and design services are quoted separately.

Optional AI subscriptions renew monthly through PayPal unless canceled. Cancellation stops future renewals, with remaining AI plan benefits continuing through the paid period. The editor and downloads remain free. View your plan and renewal date in your dashboard.

AI allowances depend on your selected plan. One successful assistant response uses one request; a listing may require multiple responses. Manual editing, resizing and downloading use no AI requests. Included allowances reset each paid billing period and do not roll over. Existing founding member allowances reset each calendar month in UTC. Free accounts and trial records include no AI allowances. AI features require paid access.

Confirmed accounts can buy 10 assistant requests for $9 as a one-time purchase. Purchased requests do not expire and do not require a subscription. They are used after your included allowance. Extra assistant requests cannot be exchanged for photo enhancements or headshots.

Misuse and Termination

We may suspend or terminate access if we reasonably believe an account is being used for misuse, spam, fraud, unlawful conduct, security abuse, or any activity that threatens the integrity of the product or other users.

Limitation of Liability

To the fullest extent permitted by law, Mark My Listing and its operators will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from your use of the platform.

Our total liability for claims related to the service will be limited to the amount you paid to Mark My Listing for the applicable subscription period giving rise to the claim, unless a different limitation is required by law.

Governing Law

These Terms are intended to be governed by the applicable laws of the operator's jurisdiction. A final governing-law designation may be added here as the service and business operations continue to formalize.
